LLOYD TATUM, JUDGE This is an appeal by the State pursuant to Rule 9, Tennessee Rules of Appellate Procedure, from a judgment by the Criminal Court finding that the District Attorney General abused his discretion in denying pretrial diversion of prosecution for the offense of of misrepresentation to obtain unemployment compensation benefits. Another panel of this court granted permission to appeal after overruling the defendant's motion to dismiss the State's application as being untimely and in violation of his constitutional right to a speedy trial. After considering the case on its merits, we conclude that the trial Judge was in error in finding that the District Attorney General abused his discretion in denying pretrial diversion.
